The case stemmed from a December 24, 2020, multi-vehicle accident on I-24, initiated after Ada Sanchez stopped her vehicle in the travel lane due to a charging pit bull. After the dog was removed from the road, Sanchez remained stationary, causing a chain-reaction collision. Tragically, Leishan Kifilu died in the incident.

Sanchez later filed suit against several parties, including the deceased Ms. Kifilu, claiming negligence. Representing the Estate of Leishan Kifilu, McLemore Law PLLC filed a Motion for Summary Judgment, arguing the plaintiff failed to prove breach, cause in fact, and proximate cause. The Court agreed, finding no evidence Ms. Kifilu caused any impact to Sanchez’s vehicle.

Judge Darrell Scarlett signed and entered the memorandum order on April 15, 2024, granting summary judgment in favor of the Estate and dismissing the claim. Additional related lawsuits and a counterclaim from the incident remain pending.
