The final personal injury claim in this protracted litigation was tried on February 28 and March 1, 2017, before Judge Kelvin Jones in Davidson County. Plaintiff Candes Prewitt, represented by attorney Chris Crase, testified on her own behalf but did not call any additional witnesses.

The Court denied multiple efforts to admit her medical bills and records into evidence, granting a directed verdict excluding all of her claimed medical expenses.

On March 1, 2017, Kamal Brown presented two witnesses in his defense. In closing arguments, McLemore Law emphasized discrepancies in Ms. Prewitt’s testimony and questioned the credibility of her claims. The jury returned a verdict of $500.00, far less than what Ms. Prewitt had requested for alleged extreme pain and emotional distress from a June 1, 2013 auto accident.

Ms. Prewitt filed a Motion for New Trial asserting nine alleged errors by the trial court. The motion was denied on June 2, 2017, and Ms. Prewitt appealed the ruling to the Tennessee Court of Appeals. The appellate phase followed, eventually resulting in the appellate court’s full affirmation of the trial court’s decision on April 30, 2018 (see related post).
