Summary:
McLemore Law PLLC secured a judgment as a matter of law for Candis M. Lindsey in a wrongful death lawsuit stemming from a three-vehicle collision on State Highway 109. Despite a $10 million claim, the court found no evidence of negligence by Ms. Lindsey and dismissed her from the case with prejudice.

Description:
Case Name: Shawn Gray, Individually, and as Administrator of the Estate of Angela D. Gray, Deceased, Jeremy G. Baird v. Candis M. Lindsey, Sonya Baird and Terry Baird, Individually, and d/b/a Exposure Advertising
Court: Circuit Court of Rutherford County, Tennessee at Murfreesboro
Case No.: 70471

The case arose from a tragic motor vehicle accident on March 4, 2015, in Wilson County. Angela Gray lost her life after her vehicle was struck by Jeremy Baird’s vehicle, which hydroplaned into her lane due to standing water on the roadway. The impact pushed Ms. Gray’s vehicle into the oncoming lane, directly in the path of Candis Lindsey, who had been traveling southbound under the posted speed limit on her way home from class.

McLemore Law PLLC established during discovery that Ms. Lindsey had no opportunity to avoid the collision, as she had already begun braking when she saw Mr. Baird’s vehicle fishtail. The evidence showed Ms. Lindsey maintained her lane, was not speeding, and was not at fault for the chain of events that led to the fatal accident.

On May 7, 2018, Circuit Judge Barry Tidwell granted summary judgment in favor of Ms. Lindsey and dismissed her from the case with prejudice. The lawsuit remains pending against the other named defendants.
