The lawsuit arose from an April 4, 2016, rear-end accident in Davidson County. Amir Shamoun sought $750,000.00 in damages, claiming that the crash caused a cervical disc herniation requiring fusion surgery and leading to permanent disability. The claims were directed at both driver Ronnie Buggs and his alleged employer, Fashion Hardware Group, Inc.
After taking over the case on September 12, 2018, McLemore Law determined that service had never been effectuated on Fashion Hardware Group, successfully removing them from the case. The firm then focused its defense on Mr. Buggs, conducting thorough discovery and reviewing the plaintiff’s medical history.
McLemore Law discovered that Mr. Shamoun’s spinal issues predated the accident and had been documented in prior workers’ compensation claims. After this information was presented, the plaintiff’s attorney withdrew from representation, and Mr. Shamoun continued pro se.
On May 26, 2020, McLemore Law filed a Motion to Dismiss. Following multiple hearings, the court granted the motion and dismissed all claims against Mr. Buggs on January 19, 2021.
