Description:
Case Name: Allstate Vehicle and Property Insurance Company v. Kenneth Woods and Kecia Woods
Court: United States District Court for the Western District of Tennessee, Western Division
Docket No.: 2:22-cv-02612 (Fowlkes/Pham)

The case originated from a coverage dispute after Boaz Construction sued Kenneth and Kecia Woods in Fayette County Circuit Court, claiming it was owed additional payment for prior repair work. The repairs were associated with an earlier weather-related damage claim for which Allstate had issued payment.

McLemore Law PLLC, representing Allstate, filed a declaratory judgment action in federal court on September 14, 2022, seeking clarification that the claim was not covered under the Woods’ homeowners insurance policy. A Motion for Judgment on the Pleadings was filed on March 10, 2023. Shortly after, the Woods stipulated that the damages sought by Boaz Construction were not covered under their policy. This led to a judgment of dismissal with prejudice entered on May 13, 2023.
